Jennifer Tichelaar's primary areas of practice are litigation, creditors' rights, real property law, and business law. Ms. Tichelaar represents financial institutions in the areas of banking law and creditors' rights, including collections and related litigation. Ms. Tichelaar's practice also focuses on real property law, with particular emphasis in construction lien litigation. In addition to construction lien litigation, Ms. Tichelaar handles various real estate title litigation matters, including mortgage priority disputes, adverse possession claims, boundary disputes, and easement issues. Ms. Tichelaar also represents businesses in all aspects of business law, including business formations, transactions, and litigation.

Representative Experience

  • Represented individuals and business owners with business entity formations, dissolutions, and various business transactions.
  • Actively pursued and received tax and wage garnishments for creditor clients.
  • Represented lenders, developers, contractors, and lien claimants in construction lien claims and foreclosures.
  • Represented title insurance companies and their insureds in various real estate title disputes, including mortgage priority disputes, adverse possession claims, boundary disputes, easement issues, and construction lien claims.
    • Represented buyers of structured settlements in obtaining court ordered approval of the structured settlement sale.
    • Represented a homeowner in a construction negligence jury trial. Drafted subsequent Brief on Appeal wherein the Michigan Court of Appeals reinstated the Jury Verdict overturned the Trial Court’s decision to grant Defendants’ Motion for JNOV. Heaton v Benton Constr Co, 286 Mich App 528, 780 NW 2d 618 (2009)
    • Successfully represented a construction company in an American Arbitration Association (AAA) arbitration proceeding.
    • Negotiated a global settlement of all claims and counterclaims in which our client secured its intended first priority mortgage lien on the disputed property.

    • Uncovered Register of Deeds error in the liber and page of the initial mortgage through thorough investigation to determine an equitable subrogation agreement to be made on behalf of our client and successfully negotiated a settlement to place our client in a first-priority lien position ahead of a $1.7 million future advance construction loan and mortgage.
